Auto Insurance
Most personal injury claims involve auto accidents. Car accidents are covered by car insurance coverage. However, there are other types of personal injury claims, such as slip and falls, premises liability, dog bites, medical malpractice, product defects, workers’ compensation, etc. There are different types of liability insurance which may cover such injuries, depending on the circumstances of the injury and where the injury occurred.
Business or Commercial Insurance
Although not mandatory for businesses operating in Florida, most businesses carry General Liability Insurance (business or commercial insurance) which covers, among other things, bodily injury and property damage claims arising out of premises, operations, or products. Most business premises liability claims (slip and falls, faulty steps, obstructed walkways, inadequate lighting, etc.) are made against business liability insurance policies.
Worker’s Compensation Insurance
Workers Compensation Insurance is required for any Florida business with at least four full or part-time employees (partners and sole proprietors do not count as employees in Florida). For the construction industry, workers compensation is required for just one full or part-time employee. Different requirements apply to the agricultural industry. Florida also requires that businesses that use cars or trucks for the business carry a commercial vehicle policy with minimum auto insurance.
Homeowner’s Insurance
Although Florida law does not require homeowners’ insurance, lending institutions generally require insurance coverage on the home if there is a mortgage. The homeowners’ insurance does not only cover structural property damage, it also covers personal injuries to guests invited to the property, such as slip and falls, dog bites, swimming pool accidents, etc. The homeowner’s insurance can cover a broad spectrum of personal injury cases, such as ATV accidents, defamation of character claims, false imprisonment, etc. Generally, however, intentional torts, such as assault and battery, and dog bites are excluded. Also, in addition to liability coverage, homeowner’s insurance policies often provide medical payment coverage, which is provided regardless of fault to the injured person.
